CRWDEX Privacy Policy

Your privacy is important to us. This statement outlines CRWDEX policy on how we collect personal information and how we maintain, use, store and disclose the personal information we hold and reflects our commitment to you. It applies to all operations by CRWDEX Pty Ltd (“CRWDEX”, “we”, "our” or “us”) including visitors to our website.

It is the policy of CRWDEX to respect the confidentiality of information and the privacy of individuals. CRWDEX are bound by the Australian Privacy Principles (“APP”) contained in the Privacy Act 1988 (“Privacy Act”).

CRWDEX’s privacy policy (“Privacy Policy”) will be reviewed and updated from time to time to take account of new laws and technology, changes to our operations and practices and to make sure it remains appropriate to the changing environment. Please regularly check our privacy policy so that you are aware of these updates and changes. Any information we hold will be governed by the most current version of the Privacy Policy.

1. Types of personal information held by CRWDEX and when and how it is collected

This Privacy Policy applies to the personal information of our members joining to seek opportunities to become crew members of vessels (“Crew”), members joining to connect with potential Crew (“Vessels”, “Vessel Captains”, “Captains”, “Vessel Owners”), and website users.

1.1 Personal Information

Personal information includes information regarding contact details, work experience and qualifications, opinions about job performance (e.g. references), incidents, payment information, and other information obtained or received by us in connection with possible and actual connections.

1.2 Sensitive information

Sensitive information is a special category of personal information under the Privacy Act. It is information or opinion about you, including membership of a professional or trade association or membership of a trade union; criminal record; health information, racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, or sexual preferences or practices. As outlined in the Privacy Act, sensitive information can, in most cases, only be disclosed with your consent.

2. For Crew

2.1 Collection

We may collect personal or sensitive information about you when:

  1. You complete one of our registration forms or provide any information in connection with your application or otherwise
  2. We receive any reference about you
  3. We receive results of inquiries that we might make of your former employers, work colleagues, professional associations or registration and government bodies
  4. We receive the results of any competency or background checks including but not limited to work rights, credit and criminal record checks
  5. We receive any complaint or other information from or about you in the workplace
  6. We receive any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you 2were involved
  7. We collect information about you from public domain sources

2.2 Purposes and use for which we collect personal information

Your personal and sensitive information may be used in connection with:

  1. Your actual or potential connections
  2. Our assessment of your performance
  3. Informing you of potential opportunities
  4. Our management and resolution of any complaint, inquiry or investigation in which you are involved
  5. Any insurance claim or proposal that requires disclosure of your personal or sensitive information
  6. Undertaking checks to verify your work rights status, criminal history and any other background checks, and otherwise as permitted by law
  7. Processing of payments
  8. For research, development, business systems and infrastructure testing, and other business purposes to assist us in providing our services to you

3. Disclosures

We may disclose your personal information (including to third parties) for the purposes for which it is primarily held or for a related secondary purpose and in some cases we may only disclose information with your consent. Your personal and sensitive information may be disclosed to:

  1. Potential and actual connections who may be based outside of Australia
  2. CRWDEX employees
  3. Referees
  4. External providers used in providing our services to you. For example, background checking agencies - e.g. criminal record, work rights, qualification status.
  5. Third party outsourced IT, including cloud-based storage providers, and document storage providers where we have an appropriate processing agreement (or similar protections) in place providing us with specialised and efficient database management, development and storage, who may be based outside of Australia.
  6. Payment processing services such as SWIPE
  7. Marketing technology platforms and suppliers who assist us with the provision of marketing communications to you, and customer feedback survey providers that may be based outside of Australia.
  8. Third parties used by our clients as part of their administration, screening and selection processes
  9. Internal and external auditors of CRWDEX or our clients when we are required to share this data with them upon request to comply with our contractual or regulatory obligations
  10. Third parties who assist us by developing services and processes to optimise and improve the quality and efficiency of the services provided by CRWDEX
  11. Our insurers
  12. A professional association or registration body that has a legitimate interest in the disclosure of your personal and sensitive information
  13. A Workers Compensation body
  14. Any person with a lawful entitlement to obtain the information
  15. If CRWDEX merges with or is acquired by another business or company in the future, (or is in meaningful discussions about such a possibility) we may share your personal data with the (prospective) new owners of the business or company
  16. Artificial Intelligence Tools such as algorithms or machine learning (including those provided by third parties)

Should your information be disclosed to any third parties in accordance with this policy and otherwise in compliance with the APP, it may be stored by these third parties on their systems in accordance with the third party’s privacy policy and their obligations under the APP as applicable.

4. For Vessel Captains

If you are a CRWDEX Vessel, CRWDEX will need to collect and use information about you, or individuals at your organisation, in the course of providing you or offering you our services. CRWDEX will collect client personal data that we receive from you or collect or receive from other sources. Personal information from other sources may include, where appropriate and in accordance with any applicable laws and requirements, we may seek more information about you or your colleagues from other sources generally by way of due diligence or other market intelligence; from third party market research and by analysing online and offline media. To the extent that you access our website or read or click on an email from us, where appropriate and in accordance with any applicable laws and requirements, we will also collect your data automatically or through you providing it to us.

The main reason for using information about clients is to enable us to ensure we can provide our services to connect you with Crew and that the contractual arrangements between us can properly be implemented so that the relationship can run smoothly.

We manage your data to facilitate this by:

  1. Storing your details (and updating them when necessary) on our database, so that we can contact you in relation to our online marketplace activities. This information may be disclosed to CRWDEX employees and contractors who assist with maintenance and development of our IT systems and infrastructure in Australia and elsewhere
  2. Keeping records of our conversations and meetings, so that we can provide targeted services to you
  3. Undertaking customer satisfaction surveys, and the third-party platform we use to undertake this service may be based outside of Australia
  4. Processing your data for the purpose of targeting appropriate marketing campaigns for our services, to do this we use marketing technology platforms and suppliers who assist us, and such providers may be based in the United States of America or elsewhere.

5. How do we store and protect personal information?

Safeguarding the privacy of your information is important to us, whether you interact with us personally, by phone, mail, over the internet or other electronic medium. We hold personal information in a combination of secure computer storage facilities and paper-based files and other records and take such steps as are reasonable in the circumstances to protect the personal information we hold from misuse, interference and loss, unauthorised access, modification or disclosure. We may need to maintain records for a significant period. However, when we consider information is no longer needed, we will remove any details that will identify you or we will securely destroy the records.

6. How do we keep personal information accurate and up to date?

CRWDEX takes such steps as are reasonable in the circumstances to ensure that the personal information it holds and discloses are accurate, up to date, complete, relevant and not misleading. We recognise that information changes frequently with changes of address and other personal circumstances. We generally update your customer information over the telephone or via email. Please advise your consultant when your personal details change.

If you have created a profile via our website, you are able to review and edit your personal information at any time by logging into your account and reviewing your profile. You can delete your personal information or close your account by contacting the Privacy Officer. If you do choose to close your account with CRWDEX, CRWDEX may retain personal information from your account as and where required by law.

7. General information collected from visitors to our website

CRWDEX acquires data regarding our website visitors in a collective manner, identifying frequently accessed regions and popular service offerings. Such information is utilised exclusively in an anonymous and aggregated format. This process may involve the implementation of cookies or similar technological tools to distinguish your specific browser during online interactions. These analytics assist us in evaluating beneficial features and refining the comprehensive digital experience for our website users. We refrain from disclosing specific details concerning individual visits to the CRWDEX platform.

On occasion, we require personal information, including your name, contact details, and electronic mail address. This data is collected should you register for a service through our portal. Additionally, we may request details regarding your professional expertise and requirements to ensure the provision of optimal service and a tailored online environment.

8. Enquiries & Complaints

9. Complaints

We aim to acknowledge receipt of all complaints within 10 working days and aim to resolve all complaints within 30 working days. This may not be possible in all circumstances depending on the contents of the complaint. In this situation, we will respond to your complaint in a reasonable time. If you are not satisfied with our response to your complaint, you can contact the Australian Information Commissioner (“OAIC”).

10. Access

Under the APP, individuals may obtain the personal data we maintain, though specific legal exclusions may apply.

To initiate an access request, you must submit a formal application to verify your identity and detail the specific records sought. Please reach out to our Privacy Officer to obtain the necessary documentation. We endeavor to process such requests within a reasonable timeframe, adhering to all statutory obligations, and will provide the data in the requested format whenever feasible.

A nominal fee may be required to facilitate this access, the details of which our Privacy Officer will clarify. Please be aware that processing times may vary, as we may need to recover archived records and conduct a review to ensure the relevance of the disclosed material.

If we decline a request for access, we will provide a written explanation outlining our reasons and the available procedures for formal escalation.

11. Corrections

Individuals possess the right to solicit amendments to their personal records if such data is considered imprecise, deficient, antiquated, impertinent, or deceptive. Upon receipt of such a request, CRWDEX will endeavor to address the matter within a reasonable duration, ensuring all statutory obligations are met and appropriate measures are taken to rectify the held information.

In instances where a correction request is declined, we shall provide a formal written notification detailing the justification for our refusal and the avenues available for further escalation. Furthermore, you may request that a formal statement be appended to your records indicating your view that the data is inaccurate or misleading; we will take reasonable steps to ensure this statement remains associated with your personal information. To initiate a correction, please contact our Privacy Officer to request the formal application documentation. No fees will be incurred for submitting a correction request, the subsequent amendment of data, or the inclusion of a clarifying statement.
